2. Acceptance of These Terms
These Terms and Conditions govern your use of our website and purchases made through it.
By accessing our website or placing an order, you agree to these Terms and Conditions and any policies referenced here, including our Shipping and Returns policy and Privacy Policy.
Please read these terms before placing an order. If you have any questions, contact us at contact@edensherry.co.uk.
Nothing in these Terms and Conditions affects any statutory rights you may have as a consumer under applicable law.
3. Our Products
EDEN SHERRY creates expressive garments and accessories using leather, deadstock materials, upcycled garments and other textiles.
Our products are produced in small quantities and, where stated, made to order. Product descriptions will provide information about materials, sizing, production arrangements and any relevant product-specific conditions.
Due to the nature of deadstock, upcycled and reclaimed materials, variations in colour, texture, grain, finish and appearance may occur between individual pieces. These variations are part of the material’s character and do not necessarily indicate a defect.
We make reasonable efforts to ensure product photographs, descriptions and colours are represented accurately. However, colours may appear differently depending on your screen, device and display settings.
Where a product has specific characteristics, limitations or variations, we will aim to explain these in its description.
4. Sizing and Product Specifications
Our products may be offered in a range of sizes. Customers are responsible for reviewing the available sizing information and selecting the size most suitable for them.
Selecting a size from our existing size range does not, by itself, constitute a bespoke or personalised order.
Where a product is individually altered, customised or made to specifications supplied by a customer, any relevant conditions will be stated in the product description or agreed with the customer before the order is confirmed.
Please contact us before ordering if you need clarification about measurements, fit or product specifications.
5. Made-to-Order Production
Unless otherwise stated in the relevant product description, our garments and accessories are produced to order rather than held as ready-to-ship stock.
Please allow up to 14 days for production before dispatch, as stated in our Shipping and Returns policy. This production timeframe does not necessarily include delivery time after dispatch.
We begin allocating production time and materials to orders after they are placed. For this reason, customers must cancel their orders within 24 hours of placing them if they wish to cancel under our standard cancellation policy.
Our 24-hour cancellation policy is intended to provide a clear deadline for standard order cancellations before production progresses.
Production times are estimates. If we become aware of a significant delay, we will contact you and explain the available options.
6. Order Cancellation Policy
Orders must be cancelled within 24 hours of being placed to qualify for cancellation under our standard cancellation policy.
A cancellation request must be received and the order must be successfully cancelled within this 24-hour period. Simply contacting us within 24 hours, without the order being cancelled within that period, does not guarantee cancellation under our standard policy.
Once the 24-hour period has passed, we are unable to offer cancellation under our standard cancellation policy. This is because production may have commenced and materials, time and resources may have been allocated specifically to fulfil the order.
If you wish to cancel an order, please contact contact@edensherry.co.uk as soon as possible, providing your order number and a clear statement that you wish to cancel.
Important: statutory consumer rights
Nothing in this policy removes or restricts statutory cancellation rights that apply under consumer law. Where you have a legal right to cancel an online purchase, that right may continue to apply after our 24-hour standard cancellation period has passed.
For most qualifying online purchases of goods, UK consumer law provides a right to cancel during a period ending 14 days after the day on which the customer, or a person nominated by them, receives the goods. Certain exceptions apply, including to goods made to the consumer’s specifications or clearly personalised.
The fact that an item is produced after an order is placed does not, by itself, mean that it falls within the personalised-goods exception.
Where statutory cancellation rights apply, we will process cancellations and refunds in accordance with the applicable legal requirements.
7. Placing an Order
When placing an order, you agree to provide accurate and complete contact, billing and delivery information.
After submitting an order, you should receive an email acknowledging receipt. This acknowledgement does not necessarily mean that the order has been accepted.
We reserve the right to decline or cancel an order where there is a legitimate reason, including a pricing or listing error, suspected fraudulent activity, an inability to fulfil the order, or a genuine stock or production issue.
If we cancel an order after payment has been taken, we will arrange a refund of the amount paid for the cancelled order.
We will contact you using the details supplied at checkout if we need to clarify information or communicate a problem with your order.
A contract for the sale of a product is formed when we accept your order. Any order confirmation or dispatch communication will be interpreted consistently with the information provided during checkout and applicable law.
8. Prices and Payment
All prices are displayed in the currency indicated on our website and are subject to change before an order is placed.
The price applicable to your purchase is the price displayed at checkout when you submit your order, subject to correction of genuine errors where permitted by law.
Delivery charges, applicable taxes and other charges that we are required to disclose will be shown or explained during checkout where applicable.
Payment must be completed using the payment methods available on our website. Payment processing may be provided by third-party payment service providers.
If a genuine pricing error is discovered after an order has been submitted, we will contact you to explain the issue and discuss the available options. We will not use this clause to avoid a contract or legal obligation where one has already arisen.
9. Shipping and Delivery
Our Shipping and Returns policy explains our production timeframes, delivery options, estimated transit times, shipping charges and tracking arrangements.
Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures and disruption to transport services.
We will take reasonable steps to communicate significant delays and resolve delivery issues.
Unless otherwise agreed or permitted by law, we remain responsible for the goods until they are delivered to you or to a person you have nominated to receive them.
For international orders, customs duties, import taxes and other charges may apply depending on the destination country. Where these charges are payable by the customer, we will explain this in our shipping information. Customers are responsible for charges lawfully payable by them.
International customers should familiarise themselves with the import requirements that apply in their country.
Nothing in this section excludes any rights you may have if an order is not delivered within the legally required period.
10. Returns, Refunds and Exchanges
Our Shipping and Returns policy explains how to request a cancellation, return or exchange.
For most qualifying online purchases of goods, customers have a statutory right to cancel within 14 days after receiving the goods. Certain exceptions apply, including to goods made to the customer’s specifications or clearly personalised.
Our standard 24-hour cancellation policy applies to cancellations under our voluntary order cancellation process and does not replace any statutory cancellation rights.
Where a statutory cancellation right applies, we will process the cancellation and any refund in accordance with the applicable legal requirements. This may include refunding standard delivery costs where required by law.
Eligible items should be returned in accordance with our Shipping and Returns policy. Customers may be responsible for direct return postage costs where the law permits and this has been communicated appropriately.
We may offer exchanges or store credit as additional options where appropriate. These alternatives do not replace a statutory refund or cancellation right where one applies.
Items that are faulty, damaged or not as described are subject to your statutory consumer rights. Nothing in our policies limits those rights.
Where a product is genuinely made to a customer’s specifications or clearly personalised, statutory cancellation exceptions may apply. The applicability of an exception depends on the specific item and circumstances.
Please contact contact@edensherry.co.uk if you need assistance with a cancellation, return or exchange.
11. Faulty, Damaged or Incorrect Items
We take care to inspect products and package orders appropriately before dispatch.
If your order arrives damaged, faulty or different from what you ordered, please contact contact@edensherry.co.uk with your order number and, where possible, photographs showing the issue.
We ask that you notify us promptly so that we can investigate and help resolve the matter.
Depending on the circumstances and your statutory rights, available remedies may include repair, replacement, a price reduction or a refund.
Any request to report an issue within a particular period is intended to help us investigate efficiently and does not remove statutory rights that may apply beyond that period.
12. Exchanges
Where available, we may offer exchanges for another size or product, subject to availability and the applicable terms.
Please contact us before returning an item so that we can confirm the appropriate procedure.
An exchange is not a substitute for a statutory refund or cancellation right where one applies.
13. Intellectual Property
All content on this website, including product designs, photographs, imagery, graphics, logos, text, branding and other creative materials, is owned by EDEN SHERRY or used with permission, unless otherwise stated.
You may view the website and use its content for personal, non-commercial purposes.
You must not copy, reproduce, distribute, modify, publish, sell or commercially exploit our content, product imagery, designs or branding without our prior written permission, except where permitted by law.
Unauthorised use of our intellectual property may result in legal action where appropriate.
14. Website Use and Security
You agree to use our website lawfully and not to interfere with its operation or security.
You must not attempt to gain unauthorised access to our systems, introduce malicious code, interfere with another person’s use of the website, submit fraudulent information or use the website in a way that infringes the rights of others.
We may restrict access to the website where reasonably necessary to protect its security, prevent fraud, comply with legal obligations or address misuse.
15. Third-Party Services and Links
Our website may use third-party services, including Shopify, payment processors, delivery providers and external websites.
Third-party services are subject to their own terms and privacy policies. We are not responsible for the independent operation of third-party websites or services, except to the extent that applicable law makes us responsible.
Providing a link to an external website does not necessarily mean that we endorse its content or services.
16. Reviews, Feedback and Submissions
We welcome feedback about our products and services.
If you submit a review, comment, photograph or other content to us, you confirm that you have the right to provide it and that doing so does not infringe another person’s rights or breach applicable law.
We will not assume ownership of your content merely because you submit it to us.
Where we wish to use customer-submitted content for marketing or another purpose beyond the original context in which it was provided, we will seek permission where required.
We may remove or decline to publish content that is unlawful, abusive, fraudulent, misleading or otherwise inappropriate.
17. Privacy and Personal Information
We collect and use personal information to process orders, arrange delivery, communicate with customers, provide customer support and operate our business.
Our Privacy Policy explains the information we collect, how we use it, when it may be shared and the rights available to individuals under applicable data protection law.
Please review the Privacy Policy before using our website or placing an order.
18. Website Availability and Information
We aim to keep our website accurate, secure and available, but we cannot guarantee uninterrupted access or that the website will always be free from errors.
We may update product descriptions, imagery, website content and services as our business develops. Changes to product listings will not remove rights arising from an order already placed or a contract already formed.
If we identify a genuine error affecting an order, we will take reasonable steps to correct it and communicate with the customer where necessary.
19. Liability and Consumer Rights
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is unlawful.
In particular, nothing in these terms excludes or limits your statutory rights as a consumer, including rights relating to goods that are not of satisfactory quality, are not fit for their purpose, or do not match their description.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed, or for losses arising from circumstances beyond our reasonable control.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If you are purchasing as a consumer, these terms do not affect any mandatory protections available to you under applicable consumer law.
20. Events Beyond Our Reasonable Control
We will not be responsible for a delay or failure to perform an obligation to the extent that it results from circumstances beyond our reasonable control, such as severe transport disruption, natural disasters, public emergencies or significant interruptions to essential services.
Where such circumstances affect your order, we will take reasonable steps to communicate with you and identify an appropriate solution.
This section does not remove any refund, cancellation or other rights that apply under consumer law.
21. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to our business, website, products or legal obligations.
The latest version will be published on this page with an updated revision date.
Changes will apply from the date stated in the updated terms. Changes will not retrospectively remove rights or alter an existing contract where doing so would be unlawful.
We recommend that customers review these terms periodically.
22. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, except where mandatory consumer protection rules in another jurisdiction apply.
If you are a consumer, you may also benefit from mandatory rights and protections available under the laws applicable to your circumstances.
Nothing in this section prevents you from bringing a claim before a court that has jurisdiction under applicable law.
